1. Data Controller

AquaSteer Advisors is a trade name and service brand of Smartyz Inc., a corporation incorporated under the laws of the State of Delaware, authorized to conduct business in all fifty (50) states of the United States, with principal places of operations in Texas, California, and Florida.

Smartyz Inc. is the data controller responsible for collecting, processing, storing, and safeguarding your personal information in accordance with applicable federal and state privacy laws.

2. Information We Collect

Personal information you provide: Name, email address, phone number, mailing address, and any other information you voluntarily submit through contact forms, discovery calls, or during the course of our advisory services.

Project information: Pool construction project details, contracts, bids, plans, photographs, builder correspondence, and other documents shared during consultations.

Payment information: Payment is processed by our third-party payment processor (Stripe). We do not receive, access, or store your full credit card number, debit card number, or bank account details.

Usage data (collected automatically): Pages visited, time on site, referring URLs, browser type, device type, IP address, and general geographic location — collected via Google Analytics and server logs.

Cookies and similar technologies: We use cookies, pixels, and similar tracking technologies to analyze website usage and improve our services. You may control cookie preferences through your browser settings. Disabling cookies may limit certain website functionality.

We do NOT sell, rent, lease, or trade your personal data to any third party. Ever.

3. How We Use Your Information

We use your information for the following purposes:

  • To provide, deliver, and administer our consulting and advisory services.
  • To communicate with you about your project, including scheduling, deliverables, and follow-up.
  • To send requested resources, such as the “25 Questions to Ask Before Signing a Pool Contract” checklist.

  • To send marketing communications, but only with your explicit prior consent, and only from AquaSteer Advisors. You may opt out at any time.

  • To protect the rights, property, and safety of Smartyz Inc., our clients, and the public.

4. Legal Basis for Processing

We process your personal information based on:

  • Contractual necessity: Processing required to provide our advisory services.
  • Consent: Marketing communications and optional data collection.
  • Legitimate interests: Website analytics, service improvement, and fraud prevention.
  • Legal obligations: Tax, accounting, and regulatory compliance.

5. Third-Party Services

We use the following third-party service providers to operate our business. Each provider has its own privacy policy governing data they process:

Calendly — Appointment scheduling. Scheduling data is processed under Calendly's privacy policy.

Zoom — Video conferencing. Calls are recorded only with your explicit consent.

HubSpot — Customer relationship management (CRM), email communications, and form submissions.

Google Analytics — Anonymous website usage statistics. We use IP anonymization and do not collect personally identifiable information through analytics.

Stripe — Payment processing. We never receive or store your full payment card details. Stripe is PCI DSS Level 1 certified.

Vercel — Website hosting and content delivery.

We require all third-party service providers to maintain appropriate security measures and to process personal data only in accordance with our instructions and applicable law. We are not responsible for the privacy practices of third-party services.

6. Data Sharing and Disclosure

We do not sell your personal information. We may share your information only in the following limited circumstances:

  • Service providers: With trusted third-party vendors who assist us in operating our business, as described in Section 5.
  • Legal requirements: When required by law, subpoena, court order, or government regulation.
  • Protection of rights: To protect the rights, property, or safety of Smartyz Inc., our clients, or the public.
  • Business transfers: In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.
  • With your consent: In any other circumstance where you have provided explicit consent.

7. Data Retention

We retain your information for as long as necessary to fulfill the purposes described in this policy, or as required by law. Specific retention periods:

  • Consulting documents: Retained per your service tier — Navigator: 5 years, Advocate: 7 years, Principal: 10 years from project completion.
  • Marketing contacts: Retained until you unsubscribe or request deletion.
  • Website analytics: Aggregated data retained for up to 26 months per Google Analytics default settings.
  • Payment records: Retained as required by tax and accounting regulations (typically 7 years).

You may request deletion of your personal data at any time, subject to our legal retention obligations.

8. Data Security

We implement commercially reasonable administrative, technical, and physical security measures to protect your personal information, including encryption in transit (TLS/SSL), access controls, and secure storage.

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You acknowledge that you provide personal information at your own risk.

Depending on your jurisdiction, you may have the following rights regarding your personal information:

California residents (CCPA/CPRA): You have the right to know what personal information we collect, request its deletion, opt out of any sale (we do not sell your data), and not be discriminated against for exercising these rights. 10. Children's Privacy

Our website and services are not directed to children under the age of 18. We do not knowingly collect personal information from children. If you believe we have inadvertently collected information from a child, please contact us immediately at privacy@aquasteer.com and we will promptly delete the information.

11. International Data Transfers

Your information is processed and stored in the United States. If you access our website or services from outside the United States, your information may be transferred to, stored in, and processed in the United States. By using our services, you consent to such transfers.

12. Do Not Track Signals

Some browsers transmit “Do Not Track” (DNT) signals. Our website does not currently respond to DNT signals. However, you may control tracking through your browser's cookie settings or by using browser extensions.

We may update this Privacy Policy from time to time. Material changes will be communicated via email to the address associated with your account and by updating the “Last updated” date at the top of this page.
